Advocate Tembeka Ngcukaitobi, representing EFF leader Julius Malema, has indicated that they are not seeking to avoid punishment altogether, but rather a non-custodial sentence for his client. This comes after Malema's conviction on five charges related to the discharge of a firearm in 2018.
Malema was found guilty of unlawful possession of a firearm, unlawful possession of ammunition, discharging a firearm in a public place, and reckless endangerment. The incident occurred at an EFF rally in Mdantsane, Eastern Cape, where Malema fired shots into the air.
Ngcukaitobi's stance suggests that the defense is focusing on mitigating circumstances, potentially highlighting Malema's contributions to society and his commitment to rehabilitation. The sentencing hearing is scheduled for January 23, 2026.
Possible Sentencing Options
The court has various sentencing options, including direct imprisonment, correctional supervision, or a fine. Given Malema's high profile and access to resources, the defense may argue for a non-custodial sentence, emphasizing his potential for positive community contribution.
