Johannesburg – EFF leader Julius Malema said it is his party’s view that a review application does not stop Parliament from proceeding with an impeachment inquiry into President Cyril Ramaphosa.
Speaking after Ramaphosa addresse to the nation last night, after the Constitutional Court’s ruling on the Phala Phala matter, Malema called on National Assembly Speaker Thoko Didiza to continue with the work of establishing the impeachment committee and to set out clear timelines for when it will start.
He also said he expects Didiza to oppose Ramaphosa’s review application challenging the independent Section 89 panel report.
“It cannot be permissible for a president to indefinitely frustrate constitutional accountability processes by merely initiating litigation, whenever accountability becomes imminent,” Malema said.
The Constitutional Court ruled on 8 May 2026 that Parliament acted unconstitutionally when it rejected the panel’s report in December 2022 and ordered that the matter be referred to an impeachment committee.
The Presidency has confirmed Ramaphosa will seek a judicial review of the panel’s findings while maintaining that he respects the court’s judgment.

Ramaphosa made the announcement on Monday night, saying he disputes the accuracy of the report compiled by a panel led by former Constitutional Court judge Sandile Ngcobo in 2022.
It’s the basis for Parliament to establish an impeachment committee to consider the President’s conduct in the events that unfolded on his Phala Phala farm in 2020. After a court victory on Friday, the EFF is now gearing up for another legal challenge.
The party said by reviving a legal challenge against the Section 89 report, Ramaphosa is acting on political convenience rather than constitutional principle.”
