Mpumalanga – The National Prosecuting Authority is filing a formal complaint with the Magistrates Commission against Magistrate Tuletu Tonjeni after the Kwaggafontein case against Mpumalanga businessman Joe Sibanyoni was struck from the roll.
The case was struck off last week when the prosecutor failed to appear in court. Magistrate Tonjeni, who presides at the Kwaggafontein Magistrate’s Court, also found the absent prosecutor in contempt of court and issued a warrant for his arrest.
The NPA said Tonjeni’s conduct during the proceedings raised “serious institutional concerns relating to judicial decorum” and warranted a referral to the Magistrates Commission. Sibanyoni and three co-accused were facing charges in the matter. The NPA is also considering whether to re-enrol the case against them.
The complaint will be handled by the Magistrates Commission, which investigates allegations of misconduct against judicial officers and can recommend sanctions including suspension or removal from office.
